The end of a marriage is painful. Fortunately, there are times when spouses can resolve their differences in an amicable manner and move on with their lives. When the parties are able to reach an amicable agreement then, if they meet certain requirements, they may utilize California’s summary disposition process. This process allows spouses to dissolve their marriage relatively quickly and inexpensively so that they may move on with their lives. It is important that a summary disposition be handled properly, however, in order to prevent future problems. Retaining an experienced lawyer can help to ensure that the case is handled correctly. Aruna Rodrigo is a San Bernardino uncontested divorce lawyer who prides himself on providing quality service. Contact our office today to schedule a consultation.
San Bernardino divorce attorney handling cases which can be handled through summary disposition
California’s summary disposition process allows a divorce to be completed without extensive litigation or a trial. In order to be eligible for this process, the spouses must have lived in the state for at least six months. They must also meet the following criteria:
- The spouses must have been married for less than five years
- The spouses must have no children and the wife must not be currently pregnant
- Neither spouse may own real estate
- The parties must have less than $6,000 in debt, excluding any car loans
- The parties jointly owned assets must be worth less than $38,000, excluding automobiles
- Both spouses must waive any claim to spousal support
If these requirements are met then the spouses may file a Petition for a Summary Disposition. The Court will process the Petition and, shortly thereafter, issue a Decree of Divorce. It is important that this process be handled properly. If assets or debts are not included in the Petition and Divorce Decree, then the parties may have to go back to Court at a later date. Retaining a lawyer can assist with you with preventing such errors.
